The online sale dedicated to breeders at www.elvostables.com is organized by Società Agricola Elvo Stables SRL, located at via Nucleo Campasso 18, 13885 Salussola (BI), Italy.
Società Agricola Elvo Stables SRL sells horses, foals, and embryos through its website.
Participation in Elvo Breeders Sales implies the express and unconditional acceptance of the terms and conditions of the sale.
The Buyer must register through the website www.elvostables.com before being able to place their offer.
Registration and Participation
Those wishing to make an offer must register on the website following the specified procedures. This registration implies the unconditional acceptance of the terms of the online sale. Furthermore, by placing their offer, the buyer declares to be authorized to perform legal acts and to conclude a purchase contract regarding the horse, foal, or embryo in question. Società Agricola Elvo Stables SRL reserves the right to refuse registration and participation in the auction or to unilaterally interrupt it at any time. Upon request, the buyer must present a valid identification document; otherwise, they will not be authorized to participate. It is the buyer's responsibility to provide complete, correct, and truthful information at the time of registration and to ensure that the information remains up to date. Usernames and passwords are strictly personal and cannot be transferred to third parties; if the buyer suspects any misuse, they must immediately notify Società Agricola Elvo Stables SRL. The buyer is responsible for all transactions that occur through their account.
Service Conditions
The buyer is aware that the services provided through the website exclusively allow them to follow and participate in the online sale. Società Agricola Elvo Stables SRL assumes no responsibility for the operation of the online platform, such as interruptions or delays on the site during the sale. Società Agricola Elvo Stables SRL implements technical measures for data protection and requires the buyer to protect their device from viruses or harmful programs.
Lot Status and Payment
The buyer only pays for the horse/foal/embryo, without additional purchase costs (excluding VAT, if applicable).
Horses, foals, and embryos are sold in the condition they are in at the time of registration on the site. The sale takes place in accordance with Italian law upon acceptance of the offer and payment of the invoice, possibly increased by VAT. All offers and payments must be made in euros. The offer is binding, and it cannot be withdrawn once submitted.
Acceptance of the Offer and Invoicing
The seller has 24 hours to accept an offer or make a counteroffer. After this period, the submitted offer becomes effective. The seller's acceptance of the offer results in the conclusion of a binding contract. Invoicing includes the sale price plus the applicable VAT, and the amount must be paid immediately upon lot allocation.
Property Transfer and Delivery
The responsibility for the horse, foal, or embryo transfers to the buyer five days after the allocation. Ownership is transferred with the full payment of the amount. Delivery takes place in agreement with the seller after payment. In the absence of different agreements, the buyer is responsible for picking up the lot from the seller. The legal agreement is directly between the Buyer and the Seller, considering that the Seller, and not Elvo Stables Breeders Sales, is responsible towards the Buyer for any defects that the animals may present after the sale. Transport costs are borne by the Buyer.
In principle, the weaning of a foal occurs after the foal reaches the age of 5 months. The Seller must leave the sold foal with the mother until the age of 5 months, without the Buyer being required to pay any compensation. Until the actual delivery to the Buyer, the Foal remains with expenses and risks borne by the Seller. If a foal younger than 5 months is delivered unless otherwise agreed, the risk passes to the Buyer immediately after delivery.
If the horse/foal/embryo has been sold abroad, it must be provided with export documents approved by a veterinarian ASL. The sale of breeders online Elvo Stables will take care of these export documents. The costs will be invoiced to the Buyer.
Basic Conditions for Sellers
Horses/foals/embryos are sold in the condition they are in at the time of video registration.
The seller accepts the conditions (€100.00 excluding VAT to be paid at registration plus €250.00 excluding VAT in case of horse sale through the site in addition to the sales commission of 10% on the sale price) and confirms understanding them by completing the Elvo Stables Breeders Sales registration form.
Responsibility and Dispute Resolution
1. Information and Liability: Information provided about the lots is given without warranty of accuracy. Società Agricola Elvo Stables SRL cannot be held responsible for typographical errors or material errors in the catalog or on the website.
2. Export: In case of export, the buyer must provide a valid export document within three months of the sale; otherwise, VAT will be charged.
3. Dispute Resolution: In case of a dispute between the buyer and the seller, mediation will be attempted. If no solution is found, the court of Biella has jurisdiction. Italian law applies, and any dispute falls under the exclusive jurisdiction of the Commercial Court of Biella. In case of disputes, only the text drafted in the Italian language is valid.
